Привіт! Сьогодні читав рішення Верховного суду в рамках адміністративної справи, в якому чітко написано про відмову позивачу на основі публічного інтересу. При цьому орган виконавчої влади визнає відсутність закону, що комплексно б регулював це питання. Не хочеться заглиблюватися в деталі справи. Натомість мене цікавить питання: а що ж таки стоїть вище публічний інтерес чи закон?

Питання непросте. Спочатку про публічний інтерес. Не впевнений, що я правий, але, мені здається, що це суспільний або ж громадський інтерес. Мова йде про сукупність великої кількості інтересів людей, тобто, приватних інтересів. Виражається він в тому, щоб забезпечувати цій самій спільноті, що складається з інтересів кожної окремої людини, нормальне життя. Громадський інтерес — це те, що важливо й вкрай необхідно для людей: безпека, стабільність, захист...

До речі, в англомовній версії Вікіпедії про “суспільний інтерес” він розглядається як “добробут широкої публіки”. В україномовній вказано, що захистом суспільного інтересу займаються неурядові організації, використовуючи для цього правові інструменти. І ні слова про урядові. Та, ймовірно, що цього й не потрібно писати, адже державні органи за замовчуванням повинні дбати про публічний інтерес суспільства, в якому їм самим же жити.

Мені здається, що забезпечувати публічний інтерес державні органи та їх представники можуть виключно на основі нормативно-правових актів, документів з найвищою юридичною силою! Теж же саме торкається й рішень виконавчої влади (судових органів). Керуватися ж такими категоріями як “суспільний інтерес” та опиратися на них у своїх рішеннях вкрай небезпечно. Це словосполучення має розмиті межі на відміну від законів. Та й не буде секретом те, що інтереси політичних сил не завжди збігається з реальними бажаннями суспільства. При цьому така проблема характерна для всіх країн світу. Хоча суд повинен бути поза політикою, насправді цей орган влади тісно пов'язаний з нею.

What is more important: the public interest or the law?

Hello! Today I read the decision of the Supreme Court in an administrative case, which clearly states that the plaintiff's claim is denied on the basis of public interest. At the same time, the executive body recognizes the absence of a law that would comprehensively regulate this issue. I do not want to delve into the details of the case. Instead, I am interested in the question: what comes before the public interest or the law?

It's not an easy question. First, the public interest. I'm not sure if I'm right, but it seems to me that this is the public or public interest. It is a combination of a large number of people's interests, that is, private interests. It is expressed in the way it ensures that this very community, consisting of the interests of each individual, has a normal life. The public interest is what is important and essential for people: security, stability, protection...

By the way, the English version of Wikipedia defines the "public interest" as "the welfare of the general public". The Ukrainian version states that the public interest is protected by non-governmental organizations using legal instruments. And not a word about governmental ones. But it probably doesn't need to be written, because government agencies by default have to take care of the public interest of the society in which they live.

It seems to me that public authorities and their representatives can ensure the public interest only on the basis of legal acts, documents with the highest legal force! The same applies to decisions of the executive branch (judiciary). It is extremely dangerous to be guided by such categories as "public interest" and rely on them in your decisions. This phrase has blurred boundaries, unlike laws. And it is no secret that the interests of political forces do not always coincide with the real desires of society. This problem is typical for all countries of the world. Although the court is supposed to be out of politics, in fact, this body of power is closely connected to it.
